1. Overview and Scope
This Privacy Policy describes how Kinstead, Inc. (“Kinstead,” “we,” or “us”) collects, uses, and shares personal information when you visit www.kinsteadhealth.com (the “Site”), communicate with us, or use our business services for healthcare professionals (collectively, the “Services”).
This Privacy Policy does not cover:
- Patient information.The Site and Services are provided to healthcare professionals and their business entities. We do not collect protected health information (“PHI”) through the Site. Clinical and patient information is handled by independent practices and Kinstead Provider Group, P.A. through electronic health record systems and other services under separate agreements, including business associate agreements where applicable. This Privacy Policy does not apply to that information.
- Practice websites. Websites that Kinstead builds or hosts for independent practices are operated by those practices, which maintain their own privacy policies. This Privacy Policy does not apply to those websites or their visitors.
2. Information We Collect
Information you provide. When you fill out a form, book a call, create an account, or enroll in our services, we collect information such as your name, email address, phone number, professional credentials and state(s) of licensure, practice and business information (including business entity details where you use our entity formation or maintenance services), and the contents of your communications with us. When you enroll in paid services, our third-party payment processors collect your billing information; we do not store full payment card numbers.
Information from third parties. If you submit a lead form on a third-party platform (for example, a Meta lead form on Facebook or Instagram) or book time through a scheduling tool, we receive the information you submit. We may also receive information from service providers that support entity formation, marketing, and business operations on your behalf.
Information collected automatically.When you visit the Site, we automatically collect certain information about your device, including your web browser, IP address, time zone, the pages you view, the websites or search terms that referred you to the Site, and how you interact with the Site (“Device Information”). We collect Device Information using cookies (data files placed on your device that often include an anonymous unique identifier), log files (which track actions on the Site and collect your IP address, browser type, Internet service provider, referring/exit pages, and date/time stamps), and web beacons, tags, and pixels (electronic files used to record how you browse the Site). 3. How We Use Personal Information
We use personal information to:
- Provide, operate, and improve the Site and Services;
- Set up and manage accounts, enrollments, and the business services you request;
- Process payments and invoices, including pass-through third-party costs;
- Communicate with you, including service and billing notices and — in line with the preferences you have shared with us — information or marketing relating to our services;
- Screen for potential security risks and fraud (in particular, using your IP address);
- Generate analytics about how visitors use the Site and assess the success of our marketing and advertising campaigns; and
- Comply with legal obligations and enforce our agreements.
4. How We Share Personal Information
We share personal information with the following categories of recipients:
- Service providers that process information on our behalf, such as website hosting, analytics, payment processing, communications (email and SMS), scheduling, and customer relationship management vendors, acting solely on our behalf and prohibited from using your information for their own purposes.
- Advertising and analytics partners, as described in Section 5.
- Business service partners, where needed to deliver services you enroll in — for example, state filing agents for entity formation, domain registrars, telecommunications providers, and marketing platforms such as Zocdoc.
- Legal and safety recipients, to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful request for information we receive, or to otherwise protect our rights.
- Successors, in connection with a merger, acquisition, financing, or sale of assets.
We do not sell personal information in exchange for money. Mobile opt-in data — your phone number and SMS consent — is never included in any of the sharing described above. See Section 7 for details.
5. Cookies, Analytics, and Advertising
We use Google Analytics to help us understand how visitors use the Site. You can read more about how Google uses your personal information at Google’s privacy policy page, and you can opt out of Google Analytics using Google’s browser opt-out tool.
We also use advertising technologies, including the Meta pixel, and may share identifiers and Device Information with advertising partners (such as Meta) to measure our campaigns and deliver ads, including through custom and lookalike audiences. We do not share phone numbers — in hashed or unhashed form — or SMS opt-in consent with advertising or analytics partners.
Under some state privacy laws, these activities are considered “targeted advertising.”
Your choices:you can adjust your browser settings to refuse cookies; use platform ad controls (such as Meta’s ad preferences); and opt out of targeted advertising by contacting us at support@kinsteadhealth.com (see Section 8). Where required by law, we treat recognized universal opt-out preference signals, such as the Global Privacy Control, as a request to opt out of targeted advertising.
Because there is no common industry standard, we do not respond to “Do Not Track” browser signals, other than the universal opt-out signals described above.
6. Text Messaging
If you provide a mobile phone number, we may send you text messages about our services and your account, including messages sent using automated technology. Marketing texts are sent only with your consent, and consent is not a condition of purchasing any service. Message frequency varies, and message and data rates may apply. Reply STOP to opt out of texts and HELP for help. Opting out of marketing texts does not affect transactional or account-related messages.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. This includes your mobile phone number and any SMS opt-in consent you provide to us. Text messaging originator opt-in data and consent will not be shared with any third party for any purpose.
7. Mobile Information
Mobile opt-in information — meaning your mobile phone number and your consent to receive text messages from us — is collected solely to send you the communications you’ve agreed to receive. We do not sell, rent, license, or otherwise disclose this information to any third party or affiliate, including for their own marketing purposes. This mobile information is used exclusively by Kinstead, Inc. for the purpose of providing the SMS communications program you have opted into.
8. Your Privacy Rights
Depending on where you live, you may have the right to: confirm whether we process your personal information and access it; correct inaccuracies; delete your personal information; obtain a portable copy; and opt out of targeted advertising, the sale of personal information, or certain profiling.
To exercise these rights, email support@kinsteadhealth.com with your name, state of residence, and the nature of your request. We may need to verify your identity before acting on a request. If we decline your request, you may appeal our decision by replying to it, and we will respond as required by applicable law. We will not discriminate against you for exercising your privacy rights.
If you are a European resident, you have the right to access the personal information we hold about you and to ask that it be corrected, updated, or deleted. We process your information to fulfill contracts we may have with you or to pursue the legitimate business interests described above, and your information will be transferred outside of Europe, including to the United States.
9. Data Retention
We retain personal information for as long as needed to provide the Services, maintain business and financial records, comply with legal obligations, resolve disputes, and enforce our agreements. Information associated with inquiries or leads that do not become customers is retained consistent with applicable law and deleted or de-identified when no longer needed.
10. Security
We use administrative, technical, and physical safeguards designed to protect personal information, and payment information is encrypted during transmission. No method of transmission or storage is completely secure, however, and we cannot guarantee absolute security.
11. Minors
The Site and Services are intended for individuals 18 years of age and older. We do not knowingly collect personal information from anyone under 18.
12. Changes
We may update this Privacy Policy from time to time to reflect changes to our practices or for other operational, legal, or regulatory reasons. We will post the updated version with a revised “Last Updated” date and, for material changes, provide notice on the Site or by email.
